TiVo seeks injunction against EchoStar

Tivo appears to be going for EchoStar’s* jugular after winning their civil case, where a federal jury determined that “EchoStar willfully infringed TiVo's "time-warp" patent”.

Now TiVo has filed a request for an injunction that would prohibit EchoStar from manufacturing or selling DVR products, which contain the technologies outlined in the previous civil case.

You know defending your intellectual property is fine and dandy any company should do just that, but I have to wonder about the unforeseen implications of all this for TiVo.

TiVo and DISH Network share an overlapping consumer pool to some extent; I wonder how some customers who are locked into DISH will feel about TiVo branded products if this injunction goes through.

I suppose when you feel your patents have been violated, correcting that infraction is foremost in your mind but wow, tough position to be in either way as far as I can see.
